Terms of Service

These terms are the agreement between you and Mohannad Ali (sole proprietor, operating Tomo) for your use of the Tomo mobile app and the Tomo website at heytomo.app. We've tried to keep them short and plain. By creating an account or using Tomo, you accept these terms. If you don't agree, please don't use Tomo.

Throughout this document, "we", "us", and "Tomo" refer to the operator above. "You" means the person using the service.

1. What Tomo is

Tomo is a mobile app that turns any topic you're curious about into a personalized, gamified course. Courses are generated by large language models (LLMs) on demand and presented as short daily lessons. We may add or change features over time.

2. Eligibility

You must be at least 13 years old to use Tomo. In jurisdictions where the minimum age for online consent is higher than 13 (some EU countries set it at 14, 15, or 16), the local minimum applies. If you are under the local age of legal majority, you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf.

3. Your account

You create an account by verifying a phone number. You are responsible for keeping access to that phone number and for anything that happens through your account. Tell us promptly at support@heytomo.app if you think someone else has accessed your account.

One person, one account. Don't create accounts on behalf of other people without their permission, and don't use bots or automation to create accounts.

4. SMS and carrier charges

We send a one-time login code by SMS to verify your phone number. Standard message and data rates from your carrier may apply. Tomo doesn't charge you for the SMS itself; your carrier might.

5. Your content

You own the course content you create on Tomo (topics, prompts, edits, and any text you add). By using Tomo, you grant us a worldwide, non-exclusive, royalty-free license to host, store, cache, display, and process that content for the sole purpose of running the service for you. We don't use your content to train AI models. We don't sell it.

If you choose to share a course (for example, by sending a share link or making it visible to friends), the people you share with can view it. Don't share course content if you don't want it seen.

6. AI-generated content: read this carefully

Tomo uses LLMs to generate lesson content in real time. LLMs can produce information that is incorrect, incomplete, biased, or out of date, even when it sounds confident. Treat Tomo as a curiosity tool, not a primary source.

Specifically, Tomo is not a substitute for professional advice. Don't rely on it for medical, legal, financial, safety-critical, or other professional decisions. Always verify with a qualified expert before acting on something you learned in a course.

7. In-app purchases

Tomo offers optional in-app purchases including Tomo PRO (subscription) and Sparks (one-time consumable packs). All payments are processed through the Apple App Store or Google Play Store. We never see your payment card.

• Subscriptions auto-renew unless cancelled at least 24 hours before the period ends, in line with the App Store / Play Store standard terms.
• Cancellation and refunds are handled by Apple and Google. We don't process refunds directly. See Apple's refund policy or Google's refund policy.
• Sparks are virtual items used inside Tomo. They have no real-world cash value and are not transferable, refundable outside of platform policies, or redeemable for money.
• Prices and features may change. We'll give reasonable notice in the app before changes that affect what you've already paid for.

8. Acceptable use

You agree not to:

• Use Tomo for anything illegal, harmful, threatening, harassing, defamatory, or infringing on someone else's rights.
• Generate or share content that sexualizes minors, glorifies violence, promotes self-harm, or contains hate speech.
• Reverse-engineer, decompile, or attempt to extract source code from the app or our servers.
• Scrape, mass-download, or systematically copy our content or other users' content.
• Probe, attack, or interfere with the service's integrity or performance, including via DDoS, malware, or rate-limit evasion.
• Impersonate someone else or misrepresent your identity.
• Use Tomo to develop or train a competing AI / education product (data scraping, prompt-extraction at scale, etc.).

9. Our intellectual property

The Tomo name, logo, mascot, app design, and underlying software are owned by us. We grant you a personal, non-transferable, revocable license to use the app for its intended purpose. These terms don't give you any right to use our trademarks, copy our designs, or distribute our software outside what the app normally allows.

10. Suspension and termination

We may suspend or terminate your account if you break these terms, if your use puts the service or other users at risk, or if we are required to by law. Where reasonable, we'll let you know first.

You can ask us to delete your account at any time by emailing support@heytomo.app from the address (or with the phone number) tied to your account. We verify and delete within 30 days. An in-app delete option is on the way.

11. Disclaimers

Tomo is provided "as is" and "as available". We don't guarantee that the service will always be available, error-free, or that course content will be accurate or complete. See section 6 about AI-generated content.

To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions don't allow these exclusions; in those places, the relevant disclaimer applies only to the extent permitted.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Tomo, or for any loss of data, profits, or goodwill. Our total liability to you for any claim under these terms is limited to the greater of (a) the amount you paid Tomo in the 12 months before the claim, or (b) USD 50.

Nothing in these terms limits our liability for fraud, gross negligence, or anything else that can't be limited by law.

13. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll notify you in the app and update the "Last updated" date above. Continued use of Tomo after changes means you accept the updated terms. If you don't accept them, you can stop using Tomo and ask us to delete your account.

14. Governing law and disputes

These terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-laws principles. Any dispute arising from these terms or your use of Tomo will be brought in the courts of Cairo, Egypt, except where mandatory consumer- protection laws of your country of residence give you the right to bring proceedings locally.
